Poli\u0163i\u015ftilor le sunt adresate cuvinte destul de nepl\u0103cute. \u00cen ansamblu, dup\u0103 cum am mai remarcat, noti\u0163a este deosebit de<!--more--> emo\u0163ional\u0103, \u015fi astfel de atitudini se \u00eent\u00e2lnesc destul de des. \u00cens\u0103 ea mi-a amintit de<!--more--> o circumstan\u0163\u0103 \u00eentip\u0103rit\u0103 \u00een memorie \u00eenc\u0103 de pe timpurile c\u00e2nd \u00eemi f\u0103ceam studiile la Facultatea de Drept.<\/p>\n<p class=\"MsoNormal\" style=\"text-align: justify;\">Pu\u0163ini \u015ftiu c\u0103 cele mai mari f\u0103r\u0103delegi ale poli\u0163iei sunt, \u00een esen\u0163\u0103, legiferate \u00een Republica Moldova. Nu, nu \u00een sensul c\u0103 a\u015fa s-ar fi constituit starea de lucruri, \u00een care orice abuz al poli\u0163i\u015ftilor este trecut cu vederea. Problema e c\u0103 sunt legiferate \u00een sensul cel mai direct al cuv\u00e2ntului.<\/p>\n<p class=\"MsoNormal\" style=\"text-align: justify;\">\u00cen <a href=\"http:\/\/lex.justice.md\/index.php?action=view&amp;view=doc&amp;lang=2&amp;id=312894\">Legea<span style=\"text-decoration: none; color: #000000;\"> cu privire la<span> <\/span>Poli\u0163ie <\/span><\/a>este inclus un articol interesant (art. 30), care se nume\u015fte &#8222;Obligativitatea subordon\u0103rii colaboratorilor de poli\u0163ie&#8221;. \u00cen el se stipuleaz\u0103 c\u0103 cererile <em>legale<\/em> ale colaboratorilor de poli\u0163ie sunt obligatorii pentru cet\u0103\u0163eni \u015fi<span> <\/span>func\u0163ionari. Iar nesupunerea fa\u0163\u0103 de astfel de cereri <em>legale<\/em> atrage dup\u0103 sine r\u0103spunderea stabilit\u0103 de legisla\u0163ie. \u00cen cazul \u00een care crede\u0163i c\u0103 enun\u0163urile de mai sus sunt juste, v\u0103 voi da dreptate. \u00centr-adev\u0103r, dac\u0103 cererea poli\u0163istului este legal\u0103, atunci nesupunerea reprezint\u0103 o infrac\u0163iune deosebit de grav\u0103. E o realitate absolut normal\u0103 pentru orice stat democratic.<\/p>\n<p class=\"MsoNormal\" style=\"text-align: justify;\">\u00cens\u0103 cum vom proceda \u00een cazul \u00een care cererea sau ac\u0163iunea colaboratorului de poli\u0163ie este ilegal\u0103? Nu v\u0103 gr\u0103bi\u0163i cu r\u0103spunsul, oric\u00e2t de evident v-ar p\u0103rea acesta \u0163in\u00e2nd cont de articolele citate mai sus. Pentru c\u0103 \u00een acela\u015fi articol 30 este stipulat un al treilea alineat, ultimul, care anuleaz\u0103 orice posibilitate de a riposta cumva abuzurilor &#8222;persoanelor \u00een uniform\u0103 neagr\u0103&#8221;.<\/p>\n<p class=\"MsoNormal\" style=\"text-align: justify;\">\u00cen el se stipuleaz\u0103 c\u0103 cererile unui colaborator al poli\u0163iei<span><em>, adresate cet\u0103\u0163enilor \u015fi func\u0163ionarilor, precum \u015fi ac\u0163iunile \u00eentreprinse de ace\u015ftia sunt considerate LEGALE p\u00e2n\u0103 la momentul c\u00e2nd organul sau persoana \u00eemputernicit\u0103 s\u0103 efectueze controlul asupra activit\u0103\u0163ii lui \u015fi a respect\u0103rii legalit\u0103\u0163ii, nu va stabili contrariul<\/em><\/span>.<\/p>\n<p class=\"MsoNormal\" style=\"text-align: justify;\">Cu alte cuvinte, orice ar face un colaborator al poli\u0163iei, toate ac\u0163iunile sale vor fi considerate absolut legale, p\u00e2n\u0103 la momentul c\u00e2nd ve\u0163i demonstra contrariul. \u00cen esen\u0163\u0103, aceast\u0103 situa\u0163ie face ca orice persoan\u0103 s\u0103 fie neajutorat\u0103, chiar \u015fi \u00een cazul \u00eenc\u0103lc\u0103rilor celor mai grosolane ale ap\u0103r\u0103torilor ordinii publice. \u015ei \u00een cazul \u00een care cineva va avea de suferit \u00een urma ac\u0163iunilor ilegale ale unui colaborator de poli\u0163ie, respectivul nu va avea posibilitatea s\u0103 se opun\u0103 \u015fi s\u0103 se apere, pentru c\u0103 orice ac\u0163iune de acest tip poate fi u\u015for\u00a0 catalogat\u0103 drept nesupunere fa\u0163\u0103 de ac\u0163iunile <em>legale<\/em> ale colaboratorului de poli\u0163ie.<\/p>\n<p class=\"MsoNormal\" style=\"text-align: justify;\">\u015ei doar ulterior, cet\u0103\u0163eanul are posibilitatea s\u0103 demonstreze c\u0103 ac\u0163iunile \u00eentreprinse \u00eempotriva sa au fost ilegale, \u015fi s\u0103 revendice o desp\u0103gubire pentru prejudiciul suferit. \u00cens\u0103 nu \u015ftiu de ce, am mari dubii c\u0103 p\u0103timitul va avea c\u00e2\u015ftig de cauz\u0103&#8230;<\/p>\n<p class=\"MsoNormal\" style=\"text-align: justify;\">Din punct de vedere juridic, aici apare un paradox interesant \u2013 prezum\u0163ia legalit\u0103\u0163ii ac\u0163iunilor colaboratorilor poli\u0163iei \u015fi prezum\u0163ia de nevinov\u0103\u0163ie. Adic\u0103, pe de o parte, orice ac\u0163iuni ale poli\u0163iei sunt considerate legale p\u00e2n\u0103 la momentul c\u00e2nd va fi demonstrat caracterul lor ilegal. Pe de alt\u0103 parte, orice persoan\u0103 este considerat\u0103 nevinovat\u0103 de comiterea unor delicte, p\u00e2n\u0103 c\u00e2nd vinov\u0103\u0163ia sa nu va fi demonstrat\u0103 \u00een judecat\u0103, \u00een cadrul unor dezbateri judiciare echitabile. \u00cens\u0103 cunoa\u015ftem deja \u00een favoarea c\u0103rei prezum\u0163ii se \u00eenclin\u0103 balan\u0163a justi\u0163iei moldave.<\/p>\n<p class=\"MsoNormal\" style=\"text-align: justify;\">\u00cen leg\u0103tur\u0103 cu aceasta, mi-am amintit de un dosar examinat \u00een privin\u0163a RM la CEDO, care ia o atitudine clar\u0103 la problema \u00een cauz\u0103. \u00cen dosarul <a href=\"http:\/\/cmiskp.echr.coe.int\/tkp197\/view.asp?action=html&amp;documentId=793903&amp;portal=hbkm&amp;source=externalbydocnumber&amp;table=F69A27FD8FB86142BF01C1166DEA398649\">C\u043ersac\u043ev v Moldova<\/a>, peti\u0163ionarul, Mihai Corsacov, reclam\u0103 tratamentul r\u0103u al poli\u0163iei \u015fi investigarea superficial\u0103 a incidentului de c\u0103tre autorit\u0103\u0163i. Nu voi intra \u00een am\u0103nunte (cei interesa\u0163i pot accesa link-ul ce trimite la decizia CEDO). Voi invoca doar c\u00e2teva citate din decizia \u00een chestiune, care pune \u00een eviden\u0163\u0103 foarte clar pozi\u0163ia Cur\u0163ii Europene \u00een asemenea probleme sensibile.<\/p>\n<p class=\"MsoNormal\" style=\"text-align: justify;\">Deci, CEDO a indicat urm\u0103toarele (art. 55):<\/p>\n<p class=\"JuPara\"><span>55.\u00a0\u00a0Curtea reaminte\u015fte faptul c\u0103 dac\u0103 unei persoane i se aplic\u0103 leziuni corporale \u00een perioada afl\u0103rii acesteia \u00een deten\u0163ie sau \u00een controlul poli\u0163iei, orice astfel de leziune ar da na\u015ftere unei prezum\u0163ii puternice c\u0103 acea persoan\u0103 a fost supus\u0103 unui tratament r\u0103u. \u0162ine de datoria statului s\u0103 prezinte o explica\u0163ie plauzibil\u0103 despre cum leziunile corporale au fost cauzate, \u00een cazul \u00een care statul omite s\u0103 fac\u0103 acest lucru poate exista o situa\u0163ie care s\u0103 cad\u0103 sub inciden\u0163a articolului 3 al Conven\u0163iei (\u201eInterzicerea torturii\u201d<\/span><span>). Nu este suficient ca statul s\u0103 se refere numai la achitarea ofi\u0163erilor de poli\u0163ie \u00eenvinui\u0163i pe parcursul perioadei de urm\u0103rire penal\u0103, \u015fi \u00een consecin\u0163\u0103, achitarea ofi\u0163erilor de poli\u0163ie acuza\u0163i de cauzarea unor leziuni corporale unei persoane nu va exclude sarcina proba\u0163iunii care apar\u0163ine statului, \u00een conformitate cu articolul 3 al Conven\u0163iei, de a dovedi c\u0103 leziunile corporale suferite de c\u0103tre acea persoan\u0103 pe parcursul afl\u0103rii acesteia sub controlul poli\u0163iei nu au fost cauzate de c\u0103tre ofi\u0163erii de poli\u0163ie.<\/span><\/p>\n<p class=\"MsoNormal\" style=\"text-align: justify;\"><span><em> <\/em><\/span><\/p>\n<p class=\"MsoNormal\" style=\"text-align: justify;\"><span><em><span> <\/span>(55. The Court recalls that where a person is injured while in detention or otherwise under the control of the police, any such injury will give rise to a strong presumption that the person was subjected to ill-treatment. It is incumbent on the State to provide a plausible explanation of how the injuries were caused, failing which a clear issue arises under art. 3 of the Convention. It is not sufficient for the State to refer merely to the acquittal of the accused police officers in the course of a criminal prosecution, and consequently, the acquittal of officers on a charge of having assaulted an individual will not discharge the burden of proof on the State under art. 3 of the Convention to show that the injuries suffered by that individual whilst under police control were not caused by the police officers.) <\/em><\/span><\/p>\n<p class=\"MsoNormal\" style=\"text-align: justify;\">\u015ei mai departe:<\/p>\n<p class=\"JuPara\"><span>60.\u00a0\u2026 Curtea conchide c\u0103 Guvernul nu a reu\u015fit s\u0103 prezinte probe care s\u0103 dovedeasc\u0103 faptul c\u0103 leziunile corporale au fost cauzate reclamantului \u00eentr-un alt mod dec\u00eet aplicarea unui tratament r\u0103u pe parcursul afl\u0103rii sale \u00een arest.<\/span><\/p>\n<p class=\"MsoNormal\" style=\"text-align: justify;\"><span><em> <\/em><\/span><\/p>\n<p class=\"MsoNormal\" style=\"text-align: justify;\"><span><em>60&#8230; the Court concludes that the Government have not satisfied the burden on them to persuade it that the applicant&#8217;s injuries were caused otherwise than by the ill-treatment he underwent while in police custody.)<\/em><\/span><\/p>\n<p class=\"MsoNormal\" style=\"text-align: justify;\">Cu alte cuvinte, nu persoana urmeaz\u0103 s\u0103 demonstreze c\u0103 poli\u0163ia a avut un comportament inadecvat, ci dimpotriv\u0103, colaboratorii poli\u0163iei trebuie s\u0103 probeze c\u0103 nu au admis \u00een privin\u0163a ei un tratament r\u0103u, \u015fi c\u0103 anumite traume ale re\u0163inutului nu sunt cauzate de ei. Iar \u00een cazul \u00een care nu o vor putea demonstra conving\u0103tor, se sub\u00een\u0163elege c\u0103 traumele au fost cauzate de poli\u0163ie \u00een urma tratamentului r\u0103u.<\/p>\n<p class=\"MsoNormal\" style=\"text-align: justify;\">\u00cen practica organelor de justi\u0163ie autohtone se \u00eent\u00e2lne\u015fte deseori situa\u0163ia \u00een care Procuratura d\u0103 r\u0103spunsuri standard la peti\u0163iile re\u0163inu\u0163ilor, \u00een care se sus\u0163ine c\u0103, cic\u0103, ar fi fost efectuat\u0103 o investiga\u0163ie \u015fi c\u0103 faptele invocate \u00een peti\u0163ie nu au fost confirmate. \u00cens\u0103 \u015fi \u00een privin\u0163a unor asemenea r\u0103spunsuri, Curtea European\u0103 s-a expus univoc:<\/p>\n<p class=\"MsoNormal\" style=\"text-align: justify;\"><span><em> <\/em><\/span><\/p>\n<p class=\"JuPara\"><span><em><span lang=\"FR\">66. <\/span><\/em><\/span><span>Investiga\u0163ia unor alega\u0163ii grave de aplicare a tratamentului r\u0103u trebuie s\u0103 fie complet\u0103. The investigation into serious allegations of ill-treatment must be thorough. That means that the authorities must always make a serious attempt to find out what happened and should not rely on hast or ill-founded conclusions to close their investigation&#8230; Any deficiency in the investigation which undermines its ability to establish the cause of injuries or the indentity of the persons responsible will risk falling foul of this standard.) <\/em><\/span><\/p>\n<p class=\"MsoNormal\" style=\"text-align: justify;\">Practic, Curtea European\u0103 introduce prezum\u0163ia de vinov\u0103\u0163ie a ac\u0163iunilor colaboratorilor organelor de drept. Ea declar\u0103 c\u0103 \u00een cazul \u00een care organele competente nu vor putea aduce probe concrete \u00een sus\u0163inerea faptului c\u0103 urm\u0103rile tratamentului r\u0103u nu sunt rezultatul ac\u0163iunilor poli\u0163iei, \u015fi dac\u0103 nu vor identifica adev\u0103rata cauz\u0103, atunci exist\u0103 toate motivele ca anume poli\u0163ia s\u0103 fie \u00eenvinuit\u0103 de aceasta. Mai mult, Curtea atrage aten\u0163ia asupra inadmisibilit\u0103\u0163ii r\u0103spunsurilor formale \u00een care se sus\u0163ine c\u0103 investiga\u0163ia a fost efectuat\u0103, \u00eens\u0103 pl\u00e2ngerea nu s-a confirmat.<\/p>\n<p class=\"MsoNormal\" style=\"text-align: justify;\">Dup\u0103 cum vedem, practica CEDO demonstreaz\u0103 destul de clar atitudinea negativ\u0103 vizavi de considerarea aprioric\u0103 a ac\u0163iunilor colaboratorilor de poli\u0163ie drept legitime. \u00cen cazul \u00een care exist\u0103 suspiciuni privind anumite abuzuri sau ac\u0163iuni ilegale comise de ei, anume poli\u0163ia urmeaz\u0103 s\u0103 demonstreze c\u0103 a ac\u0163ionat exclusiv \u00een cadrul legal.<\/p>\n<p class=\"MsoNormal\" style=\"text-align: justify;\">\u00cens\u0103, cu p\u0103rere de r\u0103u, nu putem conta \u00eentotdeauna doar pe Curtea European\u0103. Cazurile \u00een care dosarele ajung la Strasbourg sunt foarte rare (cel pu\u0163in, raportat la num\u0103rul de \u00eenc\u0103lc\u0103ri). Este necesar ca principiile invocate de Curtea European\u0103 \u00een deciziile sale s\u0103 fie implementate \u00een practic\u0103 de organele de drept \u015fi judec\u0103\u0163ile na\u0163ionale, aici, \u00een RM.
